I own a small business and unknowingly an X-employee planted a file
containing the trojan virus which was opened by my home computerremotely thru
my VPN which as you can imagine caused many problems including windows XP to
say it could be conterfeit or it is not geniune. the virus also reached
another one of my employees computers also working remotely (VPN) thru his
home computer. My question is, is this a crimanal afence and is it punishable
my any law enforcement? If so how do you prove the file was put there by this
employee? What evidence would you need and who would you report the incident
to?

This depends on the jurisdiction in which you are located as does the
punishment if any. I would suggest you contact your lawyer.

Again this very much depends on the jurisdiction within which you are
located. I would suspect the procedures in say the US might be very
different than those say in Russia.
