the battery saving program it will go to sleep no matter what, but when
I have it plugged in and on Max performance it will not sleep... screen
turns off, but nothing else happens...

Check the Vista Power Options settings (Control Panel > Power Options).
Select a power plan to suit the computer e.g. Balanced, Power Saver,
Performance. The default settings for these are below (at least, the
defaults here apply to my machine):

Balanced: "Turn off Display: 20 minutes", "Sleep: 1 hour"

Power Saver: "Turn off Display: 20 minutes", "Sleep: 1 hour"

Performance: "Turn off Display: 20 minutes", "Sleep: Never"

So given you're using "Max Performance" as you state above, I would guess
putting the computer to sleep is set to "never".

Go into "Change Plan Setting" for which ever one you're using ("Performance"
in this case, I assume) and change the "Go to Sleep" option to something
other than "Never"; if it's already set to a specific timeframe, make it
sooner or later to suit you.

If this doesn't solve the issue, maybe some system task is preventing the
computer entering sleep mode - could be due to network activity, or disk
defragmenter, a back up routine or any number of things.

You might even check out the "Advanced" options, because you might find
something there that prevents the sleep mode.

have you checked the settings for the power profile you are using, m
guess is you have selected 'never' for the sleep option

That would be because you chose "High Performance" as your power profile, in
that profile when the computer is plugged in the computer does not sleep,
ever. You can either choose a different profile or go to the Power Options
icon in Control Panel and set a sleep timeout period.
